TERMS OF SERVICE

Welcome to SacredSpaceUSA.com (the “Site”). The Site is operated by Danielle Heise, doing business as Sacred Space USA (“Sacred Space USA,” “we,” “us,” or “our”), a sound healing and crystal singing bowl business serving New Jersey and South Florida. These Terms of Service (“Terms”) govern your use of the Site and any content, newsletter, event information, or other services we offer through it (together, the “Services”).

By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Site, subscribe to our newsletter, or contact us. If you are under 18, please ask a parent or guardian to contact us on your behalf.

2. What the Site Offers

The Site provides information about sound bath therapy and crystal singing bowls, a blog, a questions-and-answers section, an events calendar, a contact form, and a community newsletter sign-up. Information about private bookings, workshops, classes, gatherings, and public events is provided for general purposes. The Site does not currently process payments or bookings. Any private session, workshop, or event may be subject to separate booking terms, pricing, and policies that we will share with you directly.

3. Wellness Disclaimer – Not Medical Advice

Please read this section carefully.

Sound bath therapy, crystal singing bowls, and related practices (including references to energy, chakras, vibrational medicine, and the biofield) are offered for relaxation, meditation, and general well-being. They are not a substitute for professional medical, psychological, or other licensed care.
Danielle Heise and Sacred Space USA are not providing medical advice, diagnosis, or treatment. We do not claim to diagnose, treat, cure, or prevent any disease or medical condition.
Content on the Site, including statements about stress reduction, blood pressure, immune function, pain relief, sleep, and similar topics, reflects traditional beliefs, personal experience, and general information. These statements have not been evaluated by the U.S. Food and Drug Administration. Individual experiences vary and results are not guaranteed.
Always consult a qualified healthcare professional about any medical condition, symptoms, or treatment, and before beginning any new wellness practice. Never disregard professional advice or delay seeking it because of something you read on the Site or experienced at one of our sessions.
If you are pregnant, have a pacemaker or other implanted medical device, have epilepsy or a seizure disorder, have a hearing condition or sensitivity to sound, or have any other health concern, consult your healthcare provider before attending a sound bath session.

4. In-Person Sessions and Events

If you attend a sound bath, workshop, class, or event, you do so voluntarily. Sessions may involve lying or sitting for extended periods, low lighting, and sustained sound at various volumes. You are responsible for deciding whether participation is appropriate for you and for telling us about any concern before the session begins. To the fullest extent permitted by law, you assume the ordinary risks of participating, and you agree that Sacred Space USA is not responsible for injury or loss arising from those ordinary risks. We may ask you to sign a separate participation waiver or release for certain sessions. Events hosted at third-party venues or expos (such as hotels or convention spaces) are also subject to the rules and policies of the venue and event organizer, who are independent of Sacred Space USA.

5. Events, Pricing, and Changes

Event listings, dates, times, locations, and prices on the Site may change or be canceled without notice. Please confirm details with us or the event organizer before traveling. Free events are offered at our discretion and may be limited by space.

6. Your Communications and Submissions

When you send us a message through the contact form, email, phone, or social media, or sign up for our newsletter, you agree to provide accurate information and not to submit anything unlawful, harassing, defamatory, misleading, or infringing. Please do not send sensitive medical or health information through the Site’s forms. You grant us permission to use your messages to respond to you and to operate our business. If you submit a testimonial, comment, or feedback that you permit us to publish, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it in connection with our business, and you confirm you have the right to do so.

7. Newsletter, Email, and Text Message Communications

By subscribing to the Community Newsletter, you consent to receive emails and, if you provide your mobile number and opt in, text (SMS/MMS) messages from Sacred Space USA about events, workshops, special offers, expos, and sound healing information. We use the GoHighLevel customer relationship management (CRM) and marketing platform to manage our contacts and to send these messages.

Email. You may unsubscribe at any time using the link in any email or by contacting us. We will honor unsubscribe requests as required by law.

Text messages.

By providing your mobile number and opting in, you agree to receive recurring automated marketing and informational text messages from Sacred Space USA at that number. Message frequency varies.
Consent to receive texts is not a condition of any purchase or of attending any event.
Message and data rates may apply.
Reply STOP at any time to cancel. We may send one final message confirming your opt-out. Reply HELP for help, or contact us at Dani@SacredSpaceUSA.com or 848-377-1611.
Carriers and Sacred Space USA are not liable for delayed or undelivered messages.
You confirm that you are the subscriber or authorized user of the mobile number you provide, and you agree to tell us if you change or give up that number.

8. Intellectual Property

The Site and its content, including text, articles, blog posts, graphics, logos, photographs, audio, and video, are owned by or licensed to Sacred Space USA and are protected by copyright, trademark, and other laws. You may view and share links to the Site for personal, non-commercial use. You may not copy, reproduce, modify, distribute, sell, or create derivative works from our content without our prior written permission. “Sacred Space USA” and related names and logos are our marks; you may not use them without permission.

9. Acceptable Use

You agree not to: (a) use the Site in violation of any law; (b) attempt to gain unauthorized access to the Site, its servers, or other users’ information; (c) introduce malware or interfere with the Site’s operation or security; (d) use bots, scrapers, or automated tools to collect data from the Site without permission; (e) submit spam or unsolicited commercial messages through our forms; or (f) impersonate any person or misrepresent your affiliation.

10. Third-Party Content and Links

The Site contains embedded videos (such as YouTube), social media links (Facebook, Instagram, TikTok), and other third-party content or services, as well as links to third-party websites and event venues. We do not control and are not responsible for third-party content, products, or practices. Your use of third-party services is governed by their own terms and privacy policies.

11. Educational Content

Blog posts, Q&A content, and other informational material on the Site are provided for general educational purposes. We make reasonable efforts to keep content accurate but do not guarantee that it is complete, current, or error-free. References to historical, cultural, or scientific ideas are general in nature and are not professional advice.

12. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY WELLNESS PRACTICE WILL PRODUCE ANY PARTICULAR RESULT. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SACRED SPACE USA, DANIELLE HEISE, AND OUR AFFILIATES, CONTRACTORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS, WHICHEVER IS GREATER. Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence or willful misconduct.

14. Indemnification

You agree to indemnify and hold harmless Sacred Space USA and Danielle Heise from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.

15. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use information.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. You agree to first try to resolve any dispute informally by contacting us at the email below. If the dispute is not resolved within 30 days, it will be brought exclusively in the state or federal courts located in New Jersey, and you consent to their jurisdiction. Nothing in this section prevents either party from seeking relief that the law does not allow to be waived.

17. Copyright Complaints

If you believe content on the Site infringes your copyright, send a written notice to the email below that identifies the work, the allegedly infringing material and its location on the Site, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner.

18. Changes to the Site and These Terms

We may modify or discontinue any part of the Site at any time. We may update these Terms from time to time by posting the revised version with a new Effective Date. Your continued use of the Site after changes are posted means you accept the updated Terms.

19. General

These Terms and the Privacy Policy are the entire agreement between you and Sacred Space USA regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a sale or transfer of our business.
